By using the Site, opening an account or clicking to accept or agree to the Terms of Service when this option is made available, the user accepts and agrees, on their own behalf or on behalf of their employer or any other entity (if applicable), to be bound by and comply with these Terms of Service, the Payment Terms found here below ("Payment Terms"), and any further standards, conditions, policies, guidelines and product disclosures (collectively, the "Terms"), which are incorporated herein by reference. The user also acknowledges having read and understood our Privacy Policy. If you do not wish to agree to these Terms or the Privacy Policy, you must not access or use the Site. For more detailed policies regarding the activity and use of the Site, please access the designated articles in this document.

The Customer Service team is available to answer any questions regarding the Site or the related Terms. To contact Customer Service, you can send a request through the contact form or through the internal ticket management system on the site.

USERS RESIDING IN THE UNITED STATES OR CANADA PLEASE NOTE THAT THESE TERMS OF SERVICE CONTAIN AN AGREEMENT TO ARBITRATE ALL DISPUTES, WHEREBY THE USER WAIVES THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR OTHER COLLECTIVE ACTION. SEE SECTION 17 BELOW.

1. Representations and Warranties

This Site is offered and made available to Users who are at least 18 years of age and who have the legal age to enter into a binding contract. Minors under the age of 18 and at least 16 years of age may only use the Site through an account owned by a parent or legal guardian, with their relative authorization. Minors under 16 years of age may not use the Site or the Services of Nanoinfluencerspower.com.

The Site is only available to Users who are not subject to any economic sanctions or commercial restrictions imposed by the United States, the European Union or any other applicable jurisdiction.

By using the Site, the User represents and warrants that they meet all the aforementioned eligibility requirements. If you do not meet all the aforementioned requirements, the User must not access or use the Site.

2. Key Terms

Client: a registered user who can purchase services on Nanoinfluencerspower.com.

Custom Offers: exclusive proposals that a Freelancer can create in response to specific Instructions requested by a Client.

Service Extras: additional services offered over and above the Freelancer's Service at a supplementary price defined by the Freelancer themselves.

Service Page: space where the Freelancer can describe their Service and its terms, while the Client can purchase the Service and create an Order.

Chat: place where Clients and Freelancers communicate in relation to a Service under discussion or ordered.

Orders: are formal agreements between a Client and a Freelancer.

Map or projects: is where eligible Freelancers can showcase the services they offer on Nanoinfluencerspower.com based on specific skills.

Freelancer: are users who offer and provide Services on Nanoinfluencerspower.com.

Influencers personal page: is where Freelancers can include all their information, present a work portfolio, show their Professions, and everything that could be useful to Clients.

3. Overview (summary of main terms)

Only registered Users can buy and sell on Nanoinfluencerspower.com. By registering an account, the User agrees to provide accurate, complete, and up-to-date information relating to their business or personal data and to update such data as required, without undue delay. Furthermore, it is not permitted to create an account for fraudulent or misleading purposes. The User is solely responsible for any activity on their account and for maintaining the confidentiality and security of their password. We are not responsible for any acts or omissions by the User in relation to their account.
Freelancers determine prices at their sole discretion.
Clients pay Nanoinfluencerspower.com in advance to create an Order, as further illustrated in the Payment Terms point 18.
Freelancers are required to deliver their Orders and cannot cancel them regularly or without just cause. Order cancellation will impact the Freelancer's reputation.
The only way Users are authorized to offer or accept payments is by placing an order through Nanoinfluencerspower.com.
When purchasing on Nanoinfluencerspower.com, Clients are granted all rights to the delivered work, unless otherwise specified by the Freelancer with a different agreement between Freelancer and Client and communicated to Nanoinfluencerspower.com.
Nanoinfluencerspower.com is a marketplace for digital services offered by Freelancers. Clients agree to engage all Freelancers as independent contractors and not to exercise any control over how they perform their work, nor to provide supervision or direction over the manner or means of completion of the services.
Nanoinfluencerspower.com reserves the right to use all delivered works that the Client has agreed to publish within a review or has otherwise made public, as well as logo designs, for marketing and promotional purposes of Nanoinfluencerspower.com and/or for all other purposes relevant to ensuring the operation and functioning of the Site.
User privacy is very important to us. For more information, please consult our Privacy Policy.

4. Freelancer

4.1 Basics

Freelancers offer services on Nanoinfluencerspower.com to allow Clients to purchase them.
Freelancers can also offer Custom Offers. Eligible Freelancers can also offer eligible Clients Custom Offers
For information on receiving payments, fees and taxes, consult the Payment Terms.
A Freelancer cannot promote their Services or any Nano Influencers Power.com content through the Google Ads platform.
The Freelancer's rating is calculated based on Order reviews published by Clients. High ratings allow the Freelancer to obtain the Advanced Freelancer Level. In some cases, excessively low ratings may lead to the suspension of the Freelancer's account.

4.2 Services

Services created on Nanoinfluencerspower.com are User Generated Content.

Services and/or Users may be removed from the Nanoinfluencerspower.com Site for violations of the Terms, which may include (but is not limited to) the following violations and/or materials:

Illegal or fraudulent Services
Copyright infringement, trademark infringement, and third-party Terms of Service violations reported through our Intellectual Property Claims Policy.
Adult, pornographic, inappropriate/obscene Services
Intentional copies of Services
Spam, senseless, violent or deceptive Services
Deceptive Services for Clients or others
Resale of regulated goods
Offering to prepare academic work on behalf of Clients
Low quality Services or deliveries
Promotion of Nanoinfluencerspower.com and/or Nanoinfluencerspower.com Services through activities prohibited by laws, regulations and/or third-party Terms of Service, as well as through any marketing activity that negatively affects relationships with our Users or partners.
Services removed for the violations mentioned above may result in the suspension of the Freelancer's account.
Services permanently removed for violations cannot be restored or modified.
Services may be removed from listings due to: violations of our Terms, poor performance, and/or User misconduct.
Services may include website URLs in pre-approved URL templates contained in the Service Description and the Required Instructions box. Services containing websites that promote content contrary to Nanoinfluencerspower.com Terms will be removed.
Services must have an adequate image that reflects what is offered. The Freelancer must provide the same quality shown in the Service images. In the event that deliveries are regularly of lower quality than shown in the Service images, the Freelancer account may lose the Freelancer level or be permanently deactivated.
Services may contain an approved video uploaded through the Service management tools available on Nanoinfluencerspower.com.
Statements on the Service Page that compromise or circumvent these Terms are prohibited.

Custom Offer

Freelancers can send Custom Offers by responding to specific instructions from a Client.
Custom Offers are defined by the Freelancer with the exact description of the Service, the price, and the expected delivery time.
Custom Offers are sent from the chat page where the conversation takes place.
Services provided through Custom Offers cannot violate Nanoinfluencerspower.com Terms.

5. Clients

5.1 Basics

Nanoinfluencerspower.com reserves the right to use all delivered works that the Client has agreed to publish within a review or has otherwise made public, as well as logo designs, for marketing and promotional purposes of Nanoinfluencerspower.com and/or for all other purposes relevant to ensuring the operation and functioning of the Site.
Services and AI-generated content requested by the Client must comply with legal provisions.
When placing an Order on the Nanoinfluencerspower.com platform, only funds obtained from legal sources and not linked, directly or indirectly, to illicit or fraudulent activities can be used.
Refer to the Payment Terms to make payments through the Site and to learn about fees and taxes.

5.2 Non-Circumvention; Non-Solicitation

It is not permitted to offer or solicit (nor accept any offer or solicitation from) Freelancers to enter into contracts, involve, pay, or make payments outside the Nanoinfluencerspower.com site. Should the user be asked to violate this commitment, use an alternative payment method, or receive services outside of Nanoinfluencerspower.com, they must immediately report it to Customer Service by opening a ticket.
The user acknowledges and agrees that violation of this non-circumvention and non-solicitation requirement constitutes a material breach of these Terms and may result in permanent account deactivation.
Should Nanoinfluencerspower.com determine, in its sole discretion, that a Client has violated this commitment, to the extent permitted by applicable law, the Client agrees to pay Nanoinfluencerspower.com liquidated damages equal to $30,000 USD. Nanoinfluencerspower.com may charge this amount to the Client's Nanoinfluencerspower.com balance, payment method, or via invoice, and may recover reasonable expenses, including collection costs and legal fees.
For any legal dispute, the court of Genoa is recognized by the users of the site as the venue for disputes.

6. Orders

6.1 Basics

Once payment is confirmed, the Order will be created.
An Order is marked as complete after being marked as delivered and then accepted by the Client. An Order will be automatically marked as "Completed" in case of non-acceptance or in the absence of modification requests within 5 days from the date it was marked as "Delivered." The Client may extend this period up to a maximum of an additional 5 days.
Some Services that involve the provision of local services may require Clients and Freelancers to meet in person. In such cases, Users must bear in mind that Nanoinfluencerspower.com does not guarantee the behavior, conduct, safety, suitability, or capacity of either Clients or Freelancers. Both Clients and accept that the entire risk arising from a meeting and/or the use or execution of local Services remains solely with them, and Nanoinfluencerspower.com has no liability regarding any local Service offered. In the event that the Services are performed at the Clients' premises, Clients are encouraged to take out adequate insurance policies to cover their liability as owners of the premises. The Terms of Nanoinfluencerspower.com remain applicable in the case of orders that are executed outside the Marketplace (including, but not limited to, the following restrictions on Illegal Use, Inappropriate Conduct and Language, and Targeted Abuse).

6.2 Managing Orders

When a Client places an Order, the Freelancer is notified via email and through site notifications, or via chat where connected to the account.
Freelancers are required to respect the delivery time specified during the creation of the Services or Custom Offers. Failure to do so may result in the Client canceling the Order if it is recognized as being more than 20 days late, and this could negatively affect the Freelancer's Level.
The Freelancer must submit Completed files and/or proof of work when marking the Order as “Delivered.”
Freelancers may not improperly communicate work delivery to circumvent the Order guidelines described in these Terms. If an Order has not been completed, it may result in the cancellation of the Order after review, affect the Freelancer's rating, and result in a financial warning to the latter.
Users are responsible for scanning all transferred files to avoid the presence of viruses and malware. Nanoinfluencerspower.com will not be held responsible for any damage that may occur due to the use of the Site, the content, or the transferred files.
Clients can inform the site if orders do not comply with the description or if they do not respect the Required Instructions sent to the Freelancer at the start of the Order process and open a dispute.
Nanoinfluencerspower.com reserves the right to mark Orders as "completed" after a revision has been requested, in cases where Clients have not responded to Freelancers or there is recognized abuse of the Nanoinfluencerspower.com Order system.

6.3 Reviews

Reviews provided by Clients are an essential part of the Nanoinfluencerspower.com rating system. Reviews will not be removed unless there are obvious violations of our Terms.
To prevent any misuse of our review system, all reviews must come from legitimate and eligible Orders. Purchases agreed upon to artificially improve ratings or improperly use the Site may result in the permanent suspension of all involved accounts.
It is prohibited to withhold delivery, files, or information necessary to complete the Services with the intent of obtaining a favorable review or additional Services. Freelancers may not solicit the removal of feedback in their Clients' reviews through mutual cancellations.
Upon completion of the Freelancer and Client reviews or after the applicable review period has passed, all published reviews will be made public.
Work samples are added to a Freelancer's resources on Nanoinfluencerspower.com if the Client chooses to publish the work sample by providing a public Review or, in the case of an AI-generated Delivery, if the Client chooses to allow others to see it.

7. User Conduct and Protection

Nanoinfluencerspower.com allows people all over the world to create, share, sell, and buy almost any service they need.

Nanoinfluencerspower.com maintains a friendly, community-oriented, and professional environment. Users must adhere to this spirit when participating in any activity or extension of Nanoinfluencerspower.com. This section addresses the conduct that Users should maintain when interacting with each other on Nanoinfluencerspower.com.

To report a violation of our Terms, misconduct by a User, or if you have questions regarding your account, please contact Customer Service.

7.1 Basics

It is not permitted to request or provide email addresses, third-party messaging applications, phone numbers, or any personal contact information for the purpose of communicating outside of Nanoinfluencerspower.com, to circumvent or abuse the Nanoinfluencerspower.com messaging system or the Nanoinfluencerspower.com platform itself.
Any exchange of personal information necessary to carry out a Service must take place within the Order chat Page.
Nanoinfluencerspower.com provides no guarantee of the level of Services offered by Freelancers to Clients. The User may use the provided dispute resolution tools.
Nanoinfluencerspower.com provides no protection to Users who interact outside the Site.
All exchanges of information and files must be carried out exclusively within the Site.
Rude, offensive, or improper language and violent or threatening messages will not be tolerated and may result in a warning or account suspension/removal.
The User undertakes not to discriminate against any other user based on sex, race, age, religious affiliation, sexual orientation, or other, and acknowledges that such discrimination may result in the suspension/removal of their account.
Users may not submit proposals or solicit third parties introduced through Nanoinfluencerspower.com to enter into contracts, engage, or pay outside of Nanoinfluencerspower.com.

7.2 Orders

Users who order competing services with the intent of defaming other Freelancers will have their reviews removed or will face further action regarding their account status, based on verification by our Protection and Security Team.
Users must refrain from spamming or soliciting previous Clients or Freelancers to remove/modify reviews or cancel orders that are not in line with the Order Cancellation or Feedback policies.

7.3 Service Page and Freelancer Page

The Freelancer warrants that any content included on the Freelancer Page is an original work conceived by the Freelancer and does not violate any third-party rights, including, without limitation, copyright, trademarks, or service marks. In the event that certain musical media or stock footage are incorporated within the Freelancer Page, the Freelancer represents and warrants that they possess a valid license to use such music and/or footage and to include it in the presentation.
Users can report Services that may violate Nanoinfluencerspower.com Terms based on the similarity of the reported Service to pre-existing Services (Copied Service) through our reporting system or by contacting Customer Service.

7.4 Reporting Violations

If the User encounters content that may violate our Terms and/or our Community Standards, they should report it to us through the appropriate channels created to manage such issues, as indicated in our Terms. All cases are reviewed by our Protection and Security Team. Our decision, among other things, may be based on the information provided. To protect individual privacy, the results of the investigation will not be shared. You can consult our Privacy Policy for further information. Misuse of our reporting system may result in the restriction or permanent suspension of related accounts.

7.5 Violations

Users may receive a warning on their account in case of violation of our Terms or any reported misconduct to our Protection and Security Team. The warning will be sent to the User's email address and will also be displayed on the Site. Warnings do not limit account activity but may lead to account suspension, removal of Services from our listings, or permanent account deactivation.
Should action be taken against a User's account or one or more Services following a violation of our Terms, we will send the User an email explaining the reasons and the basis for such action, as well as the options available for further review.

Non-Permitted Use

Adult Services and Pornography: Nanoinfluencerspower.com does not allow any exchange of adult or pornographic materials and services.
Inappropriate Conduct and Language: Communication on Nanoinfluencerspower.com must be friendly, constructive, and professional. Nanoinfluencerspower.com condemns the use of bullying, harassment, and threats towards other users. We provide Users with a means for exchanging messages between individuals, a system for evaluating orders.
Phishing and Spam: Member security is a top priority for us. Any attempt to publish or send harmful content with the intent to compromise the account or computer environment of another member is strictly prohibited. The User must therefore respect the privacy of our members by avoiding contacting them with offers, questions, suggestions, or any communication that is not directly related to the Services or Orders.
Privacy and Identity: It is not permitted to publish or post private and confidential information of others. Any exchange of personal information necessary for the performance of a Service must be provided on the Order Page. Freelancers also confirm that any information received from the Client, which is not public domain, will not be used for purposes other than the delivery of the work to the Client. All Users who interact and communicate outside of Nanoinfluencerspower.com will not be protected by our Terms of Service.
Authentic Profile: You cannot create a false identity on Nanoinfluencerspower.com misrepresent your identity, create a Nanoinfluencerspower.com profile for anyone else (who is a real person), or use or attempt to use another User's account or information; profile information, including description, skills, location, etc., must be accurate and complete and must not be misleading, illegal, offensive, or harmful. Nanoinfluencerspower.com reserves the right to require users to undergo a verification process to use the Site (using ID, phone, camera, registry extracts, documents, etc.).
Intellectual Property Claims: Nanoinfluencerspower.com will respond to clear and complete notifications of alleged copyright or trademark infringement and/or violation of third-party Terms of Service.
Fraud/Illegal Use: The User may not use Nanoinfluencerspower.com for illegal purposes or to conduct illegal activities, including the circumvention of economic sanctions or commercial restrictions imposed by the United States, the European Union, or any other applicable jurisdiction.

Abuse and Spam

Multiple Accounts: In order to prevent fraud and abuse, Users may have only one active Nanoinfluencerspower.com account and only one member in a Nanoinfluencerspower.com account. Any additional accounts created to circumvent guidelines, promote competitive advantages, or mislead the Nanoinfluencerspower.com Community will be disabled. Mass account creation may result in the disabling of all related accounts. NB: any violations of Nanoinfluencerspower.com Terms may be cause for permanent suspension of all accounts.
Targeted Abuse: We do not tolerate targeted abuse or harassment of other users on Nanoinfluencerspower.com. This includes creating multiple new accounts to harass members through our messaging or ordering system.
Account Sales: Buying or selling Nanoinfluencerspower.com accounts is not permitted.

7.6 Disputes and Cancellations

We encourage Clients and Freelancers to try to resolve any disputes between them. If for any reason this is not possible after using the Resolution Center or if unauthorized use is found on the Site, Users can contact Nanoinfluencerspower.com Customer Service for assistance. For more information on disputes, Order cancellations, and refunds, please refer to the Payment Terms.

7.7 Content Moderation, Warnings, and Appeals

Nanoinfluencerspower.com is not obligated to proactively verify the legality or compatibility of content published by Users with its Terms. However, it has the right to carry out voluntary checks on its own initiative to identify and determine illegal or incompatible content and to take appropriate measures. Nanoinfluencerspower.com reserves the right to take appropriate action if it finds, or is notified of, a violation of the Terms. For more information on content moderation processes.
In the event that Nanoinfluencerspower.com takes action against the User, their account, or their content, the User may file a complaint against that decision. The User can also file a complaint in case of disagreement with our decision following a communication sent by the User themselves. In both cases, the deadline for submitting a complaint is six months from the notification of the relative decision to the User. The User can submit a complaint by contacting Customer Service. In the complaint, the User must explain the reasons why they believe the decision should be overturned.
Complaints will be handled promptly, non-discriminatorily, diligently, and objectively, and the decision will be revoked if it is concluded that the decision was made incorrectly.
If your registered office or domicile is in the European Economic Area (EEA), the User may choose an out-of-court dispute resolution body, certified pursuant to art. 21 (3) of the EU Digital Services Act ("Out-of-Court Resolution Body") to resolve disputes relating to our decisions on uploaded content or sent warnings, including complaints that our internal complaint management system has not resolved.
We reserve the right to refuse to cooperate with the selected dispute resolution body if: (i) the relative dispute has already been resolved or is already the subject of ongoing proceedings before the competent court of Genoa or another competent dispute resolution body; or (ii) the six-month period from the notification of our decision to the User has expired without the User having filed a complaint through our internal complaint management or having contacted the dispute resolution body.
The decisions of the dispute resolution bodies are not binding on either party.

7.8 Ownership Restrictions

The Site, including features, general layout, appearance and characteristics, design, information, content, and other materials available therein (other than UGC), as well as all related intellectual property rights are the exclusive property of Nanoinfluencerspower.com. Users have no right, and specifically agree to refrain from performing the following actions in relation to the Site or any part, component, or extension of the Site (including its mobile applications and any third-party component or technology used for the operation of the Site or its features): (i) copy, transfer, adapt, modify, distribute, transmit, display, create derivative works, publish, or reproduce in any way; (ii) access it, or use any delivery, to develop or build a similar or competing product or feature, attempt to acquire ownership interests or licenses, sell, transfer, share, or sublicense (or attempt to perform any such actions); (iii) reverse assemble, decompile, reverse engineer, or otherwise attempt to derive the source code, core ideas, algorithms, structure, or organization; (iv) remove any copyright notice, identification, or any other proprietary notice; (v) use automation software (bots), hacks, modifications, or any other unauthorized third-party software designed to modify the Site; (vi) attempt to gain unauthorized access to, interfere with, damage, or disrupt the Site or the computer systems or networks connected to the Site; (vii) circumvent, remove, alter, deactivate, degrade, or frustrate any technological measure or content protection of the Site; (viii) use robots, spiders, crawlers, or other automatic devices, processes, software, or queries that intercept, "mine," scrape, or otherwise access the Site to monitor, retrieve, extract, copy, or collect content or data from or through the Site, or engage in any manual process to do the same, (ix) carry out systematic retrieval of data or content to create or compile, directly or indirectly, a collection, compilation, database, or directory; (x) introduce viruses, Trojan horses, worms, logic bombs, or other malicious or technologically harmful materials into our systems; (xi) use the Site in any way that could damage, disable, overburden, or impair the Site, or interfere with any other party's use of the Site, or (xii) access or use the Site in any way not expressly permitted by Nanoinfluencerspower.com Terms. Users also agree not to allow or authorize anyone else to do the above.

Except for the limited right to use the Site under these Terms of Service, Nanoinfluencerspower.com retains all rights, titles, and interests in and to the Site (including all intellectual property rights contained therein) and the User agrees not to take any action inconsistent with such ownership interests. We reserve all rights in relation to the Site and its content (other than UGC), including, but not limited to, the exclusive right to create derivative works.

7.9 Feedback Rights

To the extent that the User provides Nanoinfluencerspower.com with comments, suggestions, or other feedback related to the Site, as well as Nanoinfluencerspower.com products or other Services (collectively, the "Feedback"), the User shall be deemed to have granted Nanoinfluencerspower.com an exclusive, royalty-free, fully paid, perpetual, irrevocable, and worldwide ownership right in the Feedback. Nanoinfluencerspower.com has no obligation to implement any Feedback it may receive from Users.

7.10 Confidentiality

Freelancers acknowledge that Clients may need to disclose certain confidential information that will be used for the purpose of delivering the service and undertake to protect such confidential information from unauthorized use and disclosure. Therefore, Freelancers undertake to treat any information received from Clients as highly sensitive, confidential, and reserved material. Without derogating from the generality of the foregoing, the Freelancer expressly agrees to (i) treat all such information with the utmost confidentiality; (ii) not disclose the information to third parties; (iii) not use the information for any purpose other than delivering the service; and (vi) not copy or reproduce any information without the Client's permission.

8. User Generated Content

User Generated Content ("UGC") is content uploaded by Users as opposed to content created by the Site. All content uploaded to the Site by our Users (Clients and Freelancers) is User Generated Content. Nanoinfluencerspower.com does not proactively monitor the adequacy of User Generated Content, copyright infringement, trademark infringement, other rights or violations, and the User who uploads/creates such content will be solely responsible for it and for the consequences of its use, disclosure, storage, or transmission. By uploading or creating content on the Site, the User represents and warrants that they own or have obtained all necessary rights, licenses, consents, authorizations, power, and/or authority to use and/or upload such content and that such content or its use on the Site does not and will not (a) violate any intellectual property, proprietary, or privacy, data protection, or publicity rights of any third party; (b) violate any applicable local, state, federal, and international law, regulation, and convention; and/or (c) violate any policy and/or Terms of Service of the User or any third party. We invite you to report violations, attaching proof of ownership if necessary. Violating content may be removed or disabled.

Furthermore, Nanoinfluencerspower.com is not responsible for the content, quality, or level of Services provided by the Freelancer or otherwise. We make no warranty with respect to the Services on Nanoinfluencerspower.com, their Delivery, or any communication between Clients and Freelancers. We encourage users to take advantage of our rating system, our Community, and common sense when choosing appropriate Services.

By offering a Service, the Freelancer assumes responsibility for having sufficient permissions, rights, and/or licenses to provide, sell, or resell such Service offered on Nanoinfluencerspower.com. Freelancers who advertise their services online, including the service page, the freelance page, must act in compliance with the laws and Terms of Service of the relevant advertising platform or website used for advertising. Failure to do so may result in the removal of the Service, as appropriate, and the suspension of the Freelancer's account.

Freelancers may only refer to third-party names, trademarks, or brands in their content when reasonably necessary to describe their Services or when they have a valid license to use such trademarks. Unless otherwise specified, such references are permitted solely for descriptive purposes and must not suggest any unauthorized affiliation, endorsement, or sponsorship by the third-party brand or Nanoinfluencerspower.com.

For specific terms relating to intellectual property rights and to report copyright or trademark infringement claims, we invite you to consult our Intellectual Property Claims Policy, which forms an integral part of the Terms. It is our policy, in appropriate circumstances, to disable and/or terminate the accounts of users who repeatedly violate the rules.

9. Ownership

Therefore, the Freelancer expressly assigns the copyrights in the delivered work to the Client. Any transfer and assignment of intellectual property to the Client will be subject to full payment, and the delivery may not be used if payment is canceled for any reason. To be clear, in custom-made works (such as works of art, design, reports, etc.), the delivered work and related copyrights will be the exclusive property of the Client. Upon delivery, the Freelancer acknowledges and agrees that, in accordance with the Terms, all rights, titles, and interests in the delivered work are transferred to the Client. Some Services (including those for custom-made works) involve additional payments (via Extras) for the commercial use license. This means that, by purchasing the Service for personal use, the User will own all rights necessary for such use and will not need the commercial use license. Should they intend to use such Service for any other purpose or remunerative aim, or for any purpose directly or indirectly connected with any commercial activity, or other profit-making enterprise, they must purchase the Commercial Use License via an Extra and may have broader rights, consistent with business use.

Venue. 15.4 Severability

16 Payment Terms

Please read these Payment Terms carefully before making or receiving payments for services on or through the Site. By making or receiving payments for services offered on or through the Site, you consent and agree, on your own behalf or on behalf of your employer or any other organization, to be bound by and comply with these Payment Terms. These Terms are supplemental to Nanoinfluencerspower.com's general Terms of Service (collectively, the "Terms of Service").

16.1. Key Terms

Capitalized terms used but not defined herein shall have the meanings set forth in the Terms of Service.

The Nanoinfluencerspower.com Balance is the total amount of Freelancer Earnings and/or refunded payments for canceled orders as a Client.

Payment Service Providers are service providers that provide payment services to Clients and Freelancers in connection with the Site. These services include the collection of funds from Clients in connection with purchases, remittances and withdrawals of funds by and from Freelancers, as well as currency exchange services in connection with payments and withdrawals in local currency, and management of Nanoinfluencerspower.com Balance funds.

Earnings are the revenues obtained by the Freelancer on Nanoinfluencerspower.com, and may be withdrawn or used to make purchases through the Site, pursuant to these Terms.

16.2. Receiving Payments

16.2.1 General

Every Service sold and properly completed by a Freelancer results in an accreditation to their account of Earnings equal to 90% of the purchase amount.
Freelancers are responsible for paying any direct or indirect taxes, including Goods and Services Taxes, VAT, or income taxes, owed by them depending on their residence, domicile, or otherwise, in accordance with local jurisdiction. Freelancers represent and warrant that they comply, and will continue to comply at all times, with their obligations under the income tax regulations in their jurisdiction. The price indicated on the Service Page, or otherwise agreed upon between the Freelancer and the Client, is inclusive of all taxes and charges that may apply to the Freelancer.
Appointment as Limited Payment Collection Agent: Payment Service Providers simplify payments to Freelancers. Where Nanoinfluencerspower.com receives funds, the Freelancer agrees that Nanoinfluencerspower.com does so as an agent. The Freelancer therefore appoints Nanoinfluencerspower.com as its limited payment collection agent, solely for the purpose of accepting payments (via its Payment Service Provider, where applicable) from the Client and remitting those payments to the Freelancer. The Freelancer agrees that payment made by the Client to Nanoinfluencerspower.com shall be considered equivalent to a payment made directly to the Freelancer. The Client's payment obligation to the Freelancer shall be deemed fulfilled when Nanoinfluencerspower.com, through its Payment Service Providers, receives the Client's payment, and Nanoinfluencerspower.com, through its Payment Service Provider, where applicable, is responsible for remitting the funds to the Freelancer in the manner set forth in these Payment Terms. If Nanoinfluencerspower.com (through its Payment Service Providers) fails to remit amounts due to the Freelancer, the Freelancer will have recourse only against Nanoinfluencerspower.com and not directly against the Client. The Freelancer agrees that Nanoinfluencerspower.com may include or otherwise reflect these terms in any form of terms of service, receipts, disclosures or notices, including, but not limited to, receipts provided to Clients by Nanoinfluencerspower.com as deemed necessary or prudent.
Nanoinfluencerspower.com is not a Payment Service Provider. Nanoinfluencerspower.com works with various Payment Service Providers in order to collect payments from Clients, transfer those payments from Clients to Freelancers, and hold funds in relation to Nanoinfluencerspower.com Balances. None of the above payment services are performed by Nanoinfluencerspower.com itself. Furthermore, all payment services related to the withdrawal of funds from the Site are performed by Nanoinfluencerspower.com's Payment Service Providers and not by Nanoinfluencerspower.com itself. The Freelancer agrees to be bound by any additional terms and conditions provided by a Payment Service Provider, as such terms may be amended by the Payment Service Provider from time to time.

16.2.2 Withdrawing Earnings

Freelancers can withdraw their Earnings using one of Nanoinfluencerspower.com's withdrawal options (see the Withdrawal Methods section below for withdrawal fees). To withdraw available Earnings, click on the designated withdrawal provider to initiate the withdrawal process.
Your Nanoinfluencerspower.com profile can be associated with only one account for each withdrawal method on Nanoinfluencerspower.com. Your Nanoinfluencerspower.com profile can be associated with only one withdrawal account of a Payment Service Provider.
Earnings are made available for withdrawal from the Earnings page only after a 14-day clearance period after the order is marked as complete.
Nanoinfluencerspower.com may temporarily disable a Freelancer's ability to withdraw Earnings where Nanoinfluencerspower.com determines, in its sole discretion, that such action is reasonable in order to meet legal requirements, prevent fraud, or protect the rights or interests of Nanoinfluencerspower.com or third parties. Non-exhaustive examples of such suspension may occur as a result of security issues, improper conduct reported by other users, or the association of several Nanoinfluencerspower.com accounts with a single withdrawal provider.
Withdrawals can only be made to the extent of the amount available to you.
Withdrawal fees vary depending on the method and are set by the Payment Service Providers.
Withdrawals are final and cannot be canceled. We will not be able to cancel or reverse the procedure after it has been initiated.
Freelancers can indicate a bank account where to deposit their earnings or a PayPal account.
Freelancers may withdraw their Earnings from a disabled account after a 90-day security period, following full verification of the account ownership in question, from the day of the last payment received on the account and subject to Nanoinfluencerspower.com's approval.

16.2.3 Withdrawal Methods

Below are the available withdrawal methods and the withdrawal fees charged respectively by the Payment Service Providers with whom the Freelancer has chosen to open an account:

16.3. Purchases

16.3.1 General

Clients pay Nanoinfluencerspower.com to create an Order from the Service Page.
Nanoinfluencerspower.com is not a Payment Service Provider. Nanoinfluencerspower.com works with various Payment Service Providers in order to collect all payments from Clients, transfer those payments from Clients to Freelancers, and hold funds in relation to Nanoinfluencerspower.com Balances. All payment services related to the collection of funds from the Site are performed by the Payment Service Providers and not by Nanoinfluencerspower.com.
Nanoinfluencerspower.com acts as a limited payment collection agent for the Freelancer, solely for the purpose of accepting payments (via its Payment Service Provider, where applicable) from the Client and remitting those payments to the Freelancer. The Client's payment obligation to the Freelancer shall be deemed fulfilled when Nanoinfluencerspower.com, through its Payment Service Providers, receives the Client's payment, and Nanoinfluencerspower.com, through its Payment Service Providers, is responsible for remitting the funds to the Freelancer in the manner set forth in these Payment Terms. If Nanoinfluencerspower.com (through its Payment Service Provider) fails to remit amounts due to the Freelancer, the Freelancer will have recourse only against Nanoinfluencerspower.com and not directly against the Client. By accepting responsibility as the authorized limited payment collection agent for the Freelancer, Nanoinfluencerspower.com and its affiliates assume no liability for any acts or omissions of the Freelancer.
In most locations, purchases can be made on Nanoinfluencerspower.com using one of the following payment methods: credit card, PayPal. Additional payment methods may be available in some locations.
Fees (10%), VAT (22%), the cost of bank transfers (approximately 1%) are added at the time of purchase, when you can review and accept the total amount required for payment.
The User cannot propose to the Freelancer to be paid or make payments using any method different from the Site. In the event that the User receives a request to use an alternative payment method, they must immediately report it to Customer Service.
You agree to receive invoices and/or payment receipts from Nanoinfluencerspower.com in electronic format as PDF documents, via email or through the Site.

Payment Service Providers may also collect other data necessary to process withdrawal payments. Payment information provided to Payment Service Providers is subject to the Payment Service Provider's Privacy Policy and its terms and conditions.
By using any payment method and/or providing payment data to make purchases on Nanoinfluencerspower.com, you represent and warrant that: (a) you are legally authorized to provide such data; (b) you are legally authorized or have permission to make payments using the selected method(s); (c) if you are an employee or acting on behalf of a company or person who owns the payment method, you are authorized by such company or person to use that payment method to make payments on Nanoinfluencerspower.com; and (d) such actions do not violate any applicable law.

16.3.2 Currency

You can pay for services offered on or through the Site and other Orders in different currencies using your PayPal account indicated in the freelancer profile.
Your Nanoinfluencerspower.com Balance is always valued in EURO.

16.4. Taxes

Nanoinfluencerspower.com may be required by law to charge indirect taxes to users (such as sales tax, VAT, or goods and services tax) or to withhold taxes. Any amount that Nanoinfluencerspower.com is required to collect will be added to the purchase amount and any other fees owed by the Client, and any amount that Nanoinfluencerspower.com is required to withhold will be deducted from the Freelancer's Earnings, as established by applicable laws.
Indirect taxes are to be considered in addition to the prices indicated on the Site, and in any case will be shown to the Client before payment.
Users are responsible for paying any direct or indirect taxes, including Goods and Services Taxes, VAT, or income taxes, owed by them depending on their residence, domicile, or otherwise, in accordance with local jurisdiction.

16.5. Disputes and Cancellations

We encourage Clients and Freelancers to try to resolve any disputes between them. If for any reason this is not possible after using the Resolution Center or if unauthorized use of the Site is found, Users can contact Nanoinfluencerspower.com Customer Service for assistance.

16.5.1 Basics

Nanoinfluencerspower.com, through its Payment Service Provider, reserves the right to cancel Orders or suspend funds in case of any suspected violation of the law, the Terms of Service, or for fraudulent transactions carried out on the Site.
The transfer and assignment of intellectual property rights to the Client are subject to full payment by the Client. The Client will not be allowed to use the delivery if payment is canceled for any reason.
If an order is canceled (for any reason), the funds paid will be returned to the Client's Nanoinfluencerspower.com Balance.
Revisions to deliveries can be performed by Freelancers based on the Freelancer's Service and customer support. Freelancers can determine the number of revisions they want to offer, which can also be zero.
It is not permitted to request additional Services from Freelancers, in addition to those requested and agreed upon.

16.5.2 Order Cancellations

Nanoinfluencerspower.com encourages Clients and Freelancers to resolve disputes between them relating to services using the Resolution Center.
Eligibility for order cancellation requests by Nanoinfluencerspower.com will be evaluated by Nanoinfluencerspower.com based on any improper conduct, violations of our Terms of Service and/or our Community Standards, and improper use of the Nanoinfluencerspower.com delivery system.
Completed orders can be canceled, subject to review by our customer support team, based on any improper conduct, violations of our Terms of Service and/or our Community Standards, up to 7 days after the order has been marked as complete. Note that orders cannot be partially canceled (i.e., we can only cancel the entire order, in justified cases).
In rare cases where deemed appropriate, our Customer Service Team may cancel a completed Order even if 7 days have already passed since its completion.
Orders cannot be canceled based on the quality of the Service/materials delivered by the Freelancer if the Service was provided as agreed between the Freelancer and the Client. The user can leave a rating for their experience with the Freelancer on the freelancer's personal page, where they can indicate the overall level of quality of the services received.
Any unauthorized use of Nanoinfluencerspower.com found during an Order, after being examined by our Customer Service Team, may result in the Cancellation of the Order. This includes, but is not limited to, harassment, illicit behavior, or other violations of Nanoinfluencerspower.com's Terms of Service.
Nanoinfluencerspower.com will cancel Orders, based on, but not limited to, the following reasons:

Active Orders (after the requested Instructions have been sent to the Freelancer and before the Freelancer completes the delivery on Nanoinfluencerspower.com):

The Freelancer is late and does not respond for more than 48 hours while the Order has been marked as Late through customer service.
The user is abusive towards the counterparty, threatening to leave a bad rating or exploiting materials related to the order (such as login details, personal information) against the counterparty.
Users have provided or included materials that violate copyright/registered trademarks in their requested Instructions or in the Freelancer's delivery.
The user is no longer an active Nanoinfluencerspower.com user due to violations of the Terms of Service or account closure.

Delivered Orders (after the Freelancer has confirmed delivery and requested funds or before the Order is marked as complete):

The Freelancer communicates an extension of the expected delivery date to complete the requested service without providing the definitive delivered service. NB: in case of repeated infringement reports, the User's account will be permanently suspended.
The Freelancer does not deliver the files and/or proofs of work related to the agreed requested instructions for the order. NB: the subjectivity of the materials in question will be subject to review by our Customer Service Team.
The Freelancer requests additional payments, inside or outside the Site, withholding the definitive delivery of the services in direct relation to the agreed requested instructions.
The Freelancer does not deliver the definitive services pending better ratings.
Users who abuse requests in addition to those requested and agreed upon.
Users who threaten to leave a negative review to obtain more services from the Freelancer outside of those requested and agreed upon.

16.5.3 Chargebacks

Nanoinfluencerspower.com reviews chargeback cases from payment service providers and disputes on behalf of Freelancers. Although the results vary from case to case, depending on the reason for the chargeback, we always strive to resolve disputes in favor of the Freelancer. If the chargeback case allows, Nanoinfluencerspower.com, through one of its Payment Service Providers, will return part of the Earnings or the entire Earnings to the Freelancer; otherwise, the chargeback amount will be borne by the Freelancer.

16.5.4. Refunds

Nanoinfluencerspower.com does not automatically refund payments made for canceled Orders to the User's payment service provider. Funds resulting from the cancellation of an order are returned to the Client's Nanoinfluencerspower.com Balance and can be used for future purchases on Nanoinfluencerspower.com.
Refunds from the Client's Nanoinfluencerspower.com Balance (i.e., direct refunds to the payment service provider) can be requested from the billing page. The refund will be based on the payment method(s), amount, and currency you selected. To prevent fraud and abuse, we set a minimum limit for performing refunds, which is subject to review by our Customer Service Team. Such refunds may involve an additional cost.
The Freelancer can offer the Client a partial refund with respect to a specific Order or Weekly Report. Following the Client's acceptance of such partial refund, the amount will be automatically refunded to the payment method used by the Client. If Nanoinfluencerspower.com, through its Payment Service Providers, is unable to refund the agreed amount to the Client's payment method, this amount will be added to the Client's Nanoinfluencerspower.com Balance. In these cases, Customer Service must be informed in advance.

16.6. General Conditions

16.6.1 Changes

Nanoinfluencerspower.com may make periodic changes to these Payment Terms. Once these changes are made, Nanoinfluencerspower.com will make a new copy of the terms available on this page.
You understand and agree that if you use Nanoinfluencerspower.com after the date on which the Terms have changed, Nanoinfluencerspower.com will treat your use as acceptance of the updated Terms. If you do not accept the changes to the Terms, the User must deactivate their account.
Nanoinfluencerspower.com may modify these Terms due to changes in the Site and the customary course of development of our products and Services, changes in any relevant feature or functionality of the Site, changes in circumstances beyond our reasonable control, to adapt to new technologies, and to address legislative and regulatory changes, as well as security and fraud issues.

16.6.2 Applicable Law

Any claims under these payment terms relating to the processing of card transactions and payments will be governed by and interpreted in accordance with Italian laws at the court of Genoa, which the parties agree to consider the sole competent forum.
